Accord d\u2019entreprise, fusion des instances repr\u00e9sentatives du personnel\u2026 Retour sur les principaux changements.<\/em><\/p>\n<h2>Fusion des instances repr\u00e9sentatives du personnel<\/h2>\n<p>Dans les entreprises de 50 salari\u00e9s \u00e0 299 salari\u00e9s, le comit\u00e9 d\u2019hygi\u00e8ne, de s\u00e9curit\u00e9 et de conditions de travail (CHSCT), le comit\u00e9 d\u2019entreprise et les d\u00e9l\u00e9gu\u00e9s du personnel vont fusionner en une seule et m\u00eame entit\u00e9 appel\u00e9e le comit\u00e9 social et \u00e9conomique (CSE). Ce dernier aura les m\u00eames comp\u00e9tences que les trois instances qu\u2019il regroupe : expertise, action en justice, etc. Selon l\u2019accord d\u2019entreprise, il pourra \u00e9galement absorber le pouvoir de n\u00e9gociation du d\u00e9l\u00e9gu\u00e9 syndical. A noter que le CSE doit \u00eatre mis en place d\u00e8s que l\u2019entreprise compte plus de 11 salari\u00e9s.<\/p>\n<h2>Primaut\u00e9 des accords d\u2019entreprise sur celui de la branche professionnelle<\/h2>\n<p>L\u2019accord d\u2019entreprise va d\u00e9sormais pr\u00e9valoir sur l\u2019accord de branche dans la plupart des domaines \u00e0 quelques exceptions pr\u00e8s. Les textes pr\u00e9voient que la branche garde la primaut\u00e9 sur une dizaine de sujets dont les salaires minima hi\u00e9rarchiques, la mutualisation des fonds de financement du paritarisme, de la formation professionnelle, dur\u00e9e du travail, dur\u00e9es de renouvellement de la p\u00e9riode d\u2019essai, etc. La convention de branche peut \u00e9galement interdire toute d\u00e9rogation d\u00e9favorable aux salari\u00e9s par un accord d\u2019entreprise ult\u00e9rieur dans quatre domaines : pr\u00e9vention des effets de l\u2019exposition aux facteurs de risques professionnels, l\u2019insertion professionnelle et le maintien dans l\u2019emploi des personnes, l\u2019effectif \u00e0 partir duquel les d\u00e9l\u00e9gu\u00e9s syndicaux peuvent \u00eatre d\u00e9sign\u00e9s, leur nombre et la valorisation de leur parcours syndical ; les primes pour travaux dangereux ou insalubres. Enfin, un accord d\u2019entreprise peut s\u2019appliquer \u00e0 la place de l\u2019accord de branche si ses dispositions sont plus favorables.<\/p>\n<h2>N\u00e9gocier sans syndicat<\/h2>\n<p>Pour les entreprises de moins de 11 salari\u00e9s sans \u00e9lus du personnel et de moins de 20 salari\u00e9s sans CSE, les textes pr\u00e9voient que la direction puisse n\u00e9gocier avec les salari\u00e9s. Mais la ou les propositions doivent \u00eatre approuv\u00e9s par les 2\/3 des salari\u00e9s via un r\u00e9f\u00e9rendum. Dans les entreprises de moins de 50 salari\u00e9s, la n\u00e9gociation sur les accords d\u2019entreprise peut \u00eatre engag\u00e9e soit avec des salari\u00e9s mandat\u00e9s par des organisations syndicales soit avec un ou des membres \u00e9lus du CSE. Enfin, dans une entreprise de plus de 50 salari\u00e9s, la direction doit en priorit\u00e9 n\u00e9gocier avec les membres du CSE mandat\u00e9s. S\u2019il n\u2019y a pas de mandatement, la n\u00e9gociation se fait avec les membres du CSE.<\/p>\n<h2>Seuil et plafond des indemnit\u00e9s prud\u2019homales<\/h2>\n<p>Dans le cas d\u2019un licenciement reconnu comme abusif, les indemnit\u00e9s prud\u2019homales auront un seuil et un plafond. Elles seront calcul\u00e9es en fonction de l\u2019anciennet\u00e9 du salari\u00e9 et ne pourront exc\u00e9der 20 mois de salaire. Mais la mesure ne concerne pas tous les licenciements (harc\u00e8lement, discrimination, etc.). Le d\u00e9lai pour saisir les prud\u2019hommes en cas de licenciement sera limit\u00e9 \u00e0 un an. Actuellement, il est d&rsquo;un an pour les licenciements \u00e9conomiques et de deux ans pour tous les autres types de licenciement.<\/p>\n<h2>Hausse de l\u2019indemnit\u00e9 de licenciement<\/h2>\n<p>Fix\u00e9es \u00e0 1\/5e de mois de salaire par ann\u00e9e d\u2019anciennet\u00e9, les indemnit\u00e9s l\u00e9gales de licenciement passeront \u00e0 un quart de mois de salaire par ann\u00e9e d\u2019anciennet\u00e9.<\/p>\n<h2>Rupture conventionnelle collective<\/h2>\n<p>Ce dispositif permet la rupture du contrat de travail et ce, d\u2019un commun accord entre employeur et salari\u00e9s. Par ce biais, l&#8217;employeur peut organiser des d\u00e9parts volontaires sans qu\u2019il s\u2019agisse pour autant d\u2019un plan social. Pour ce faire, il faut qu\u2019un accord collectif soit n\u00e9goci\u00e9 au sein de l&rsquo;entreprise. Il devra notamment pr\u00e9voir le niveau d\u2019indemnit\u00e9.
