Il est important de faire les choses dans les r\u00e8gles, vous \u00e9viterez ainsi tout litige avec votre employeur.<!--more--><\/p>\n<p><span style=\"font-size: medium;\">Comment d\u00e9missionner ?<\/span><\/p>\n<p>Quand vous \u00eates en CDI, la d\u00e9mission est un droit et vous n&rsquo;avez pas \u00e0 motiver votre d\u00e9cision. La d\u00e9mission est impossible pour une personne en CDD.<br \/>\nPour avertir votre employeur, aucune forme n&rsquo;est impos\u00e9e, vous pouvez le faire \u00e0 l&rsquo;oral ou par \u00e9crit. Cependant,\u00a0il\u00a0est pr\u00e9f\u00e9rable de l&rsquo;avertir\u00a0dans un premier temps\u00a0de vive-voix\u00a0et d&rsquo;envoyer ensuite une lettre recommand\u00e9e avec accus\u00e9 de rendre votre d\u00e9mission officielle.<\/p>\n<p>Attention cependant \u00e0 la d\u00e9mission abusive ! Si vous d\u00e9missionnez dans le but de nuire \u00e0 votre employeur, que vous quittez votre poste du jour au lendemain ou si vous entra\u00eenez d&rsquo;autres salari\u00e9s avec vous, votre employeur pourra vous demander des dommages-int\u00e9r\u00eats.<\/p>\n<p>Enfin, lors de votre dernier jour de travail, l&#8217;employeur devra vous remettre un certificat de travail, une attestation P\u00f4le Emploi et le re\u00e7u du solde de tout compte.<\/p>\n<p><span style=\"font-size: medium;\">Le pr\u00e9avis<\/span><\/p>\n<p>La plupart des salari\u00e9s ont un pr\u00e9avis \u00e0 respecter avant de quitter leur poste. Sa dur\u00e9e est fix\u00e9e par la convention collective et diff\u00e8re donc selon la structure ou le poste. En r\u00e8gle g\u00e9n\u00e9rale, il est d&rsquo;un mois pour les employ\u00e9s et de trois mois pour les cadres. \u00c0 moins que l&#8217;employeur vous en dispense, il vaut mieux respecter ce d\u00e9lai. Si vous en respectez pas ce pr\u00e9avis, vous devrez verser des indemnit\u00e9s compensatrices \u00e0 votre employeur. Elles seront \u00e9quivalentes \u00e0 la r\u00e9mun\u00e9ration que vous auriez per\u00e7ue si vous aviez effectu\u00e9 ce pr\u00e9avis.<\/p>\n<p>Par ailleurs, une femme enceinte, ou qui est sur le point de terminer son cong\u00e9 maternit\u00e9, est dispens\u00e9e de pr\u00e9avis \u00e0 condition d&rsquo;en informer son employeur par lettre recommand\u00e9e et cela, au minimum 15 jours avant son retour pr\u00e9vu au sein de l&rsquo;\u00e9tablissement.<\/p>\n<p><span style=\"font-size: medium;\">Allocations apr\u00e8s une d\u00e9mission<\/span><\/p>\n<p>Si vous d\u00e9missionnez, vous ne percevrez pas, en principe, les allocation ch\u00f4mage. Une exception peut \u00eatre\u00a0faite dans le cas d&rsquo;une d\u00e9mission pour un motif l\u00e9gitime, lors d&rsquo;un changement de r\u00e9sidence pour suivre le\u00a0conjoint ou lors d&rsquo;un non-paiement des salaires par exemple. Si vous d\u00e9missionnez, mais que vous n&rsquo;avez pas trouv\u00e9 un autre poste, il est donc pr\u00e9f\u00e9rable de n\u00e9gocier une rupture conventionnelle avec votre employeur. Gr\u00e2ce \u00e0 cette rupture \u00e0 l&rsquo;amiable, vous b\u00e9n\u00e9ficierez des allocations ch\u00f4mage.
